1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the CappyCash platform, including our website, mobile application, and all related services (collectively, the "Platform"). By registering, accessing, or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use the Platform.

2. Eligibility

To use the Platform, you must: • Be at least 16 years of age • Be a legal resident of the United States (or other eligible region as specified during registration) • Have the legal capacity to enter into a binding agreement • Not have been previously banned or suspended from the Platform By using the Platform, you represent and warrant that you meet all eligibility requirements. One account per person and per household is permitted. Creating multiple accounts to earn additional rewards is prohibited and may result in account termination and forfeiture of all accumulated rewards.

3. Platform Description

CappyCash is a cost-per-install (CPI) and rewards platform that allows users to earn virtual points ("Coins") by completing qualifying actions, which may include: • Installing and launching mobile applications • Completing in-app milestones or tasks within partner apps • Participating in surveys • Completing sponsor tasks, offers, or promotional activities The availability of specific offers, tasks, and surveys is subject to change at any time without notice. CappyCash does not guarantee the continuous availability of any particular offer or reward opportunity.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to: • Provide accurate, current, and complete registration information • Promptly update your information if it changes • Notify us immediately at support@cappycash.com of any unauthorized use of your account • Not share your account with any other person We reserve the right to suspend or terminate accounts at our discretion, including for inactivity exceeding 12 consecutive months. Accounts inactive for 12 months may be closed following 30 days' written notice to the email address on file.

6. Redeeming Coins

Accumulated Coins may be redeemed for available prizes, gift cards, or other rewards ("Redemption Prizes") as offered on the Platform from time to time. Redemptions are subject to: • Identity and eligibility verification (see Section 7) • Minimum redemption thresholds as displayed on the Platform • Availability of selected Redemption Prize (prizes available while supplies last) All redemptions are final. Once Coins are redeemed and a Redemption Prize is issued, the transaction cannot be reversed, cancelled, or refunded, except as required by applicable law.

7. Identity Verification (KYC)

Prior to your first redemption, and at any time we deem necessary, we may require you to verify your identity. Verification may include: • Submission of a valid, unexpired government-issued photo ID (passport, driver's license, or state ID) • A selfie or liveness check via our third-party verification partner • Verification of the mobile number associated with your account Failure to complete identity verification in a timely and satisfactory manner will result in denial or suspension of your redemption request. Identity verification data is handled in accordance with our Privacy Policy.

8. Prohibited Conduct

You agree not to: • Create multiple accounts or use another person's account • Use bots, scripts, macros, emulators, VPNs, proxies, or any automated tools to complete offers, simulate installs, or manipulate activity on the Platform • Use fake phone numbers, VoIP numbers, or virtual device IDs during registration or verification • Manipulate, reverse-engineer, or exploit any offer, survey, or task to earn Coins without genuinely completing the required action • Engage in chargebacks or payment disputes in bad faith • Impersonate any person or entity, or misrepresent your identity or affiliation • Upload, transmit, or distribute any malicious code, spam, or harmful content • Interfere with the operation of the Platform or other users' experience • Violate any applicable local, state, or federal law or regulation Violation of any prohibited conduct may result in immediate account suspension or termination, forfeiture of all accumulated Coins, and potential legal action.

9. Intellectual Property

All content, features, and functionality on the Platform — including the CappyCash name, logo, graphics, text, software, and underlying code — are owned by or licensed to CappyCash and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our prior written consent.

10. Third-Party Offers and Links

The Platform contains offers and links to third-party applications, websites, and services. CappyCash does not control and is not responsible for the content, privacy practices, or terms of third-party services. Your interactions with third-party apps — including any personal data you share — are governed by those parties' terms and privacy policies. We encourage you to review them before participating in any offer.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CAPPYCASH DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS AT YOUR OWN RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CAPPYCASH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, INCLUDING LOSS OF COINS, REWARDS, DATA, OR PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnification

You agree to indemnify, defend, and hold harmless CappyCash and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your use of the Platform, or your violation of any applicable law or third-party rights.

14. Taxes

You are solely responsible for any taxes, duties, or other charges arising from your receipt or redemption of Coins or Redemption Prizes. CappyCash does not withhold taxes on rewards unless required to do so by applicable law. We may request tax information (such as a W-9) if required by U.S. tax reporting regulations.

15. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on the Platform with a revised effective date. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

16. Termination

We may suspend or terminate your account and access to the Platform at any time, with or without cause, including for violations of these Terms. Upon termination, all accumulated Coins are forfeited and no compensation will be provided. You may delete your account at any time by contacting us at support@cappycash.com.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

18. Limitation on Time to File Claims

Any claim or cause of action arising out of or related to these Terms or the Platform must be brought within one (1) year of the date the claim arose, or it will be permanently barred, to the extent permitted by applicable law.
